What is an internship contract?

First of all, you must understand what an internship contract is. It is a labor document signed by a company and a worker, the latter who is finishing or has just graduated and who, therefore, does not have any work experience. In other words, It is a contract with which you seek to apply the training you have received in your career to the world of work, having for this help from the employer to adapt and know how to do his job.

Many see it as an opportunity and a bridge to know how to apply this formative knowledge, since many times one thing is theory and another is practice. And although in the training it is well explained what has to be done, sometimes in practice it is necessary to take other steps or take into account other factors that will influence when doing it well.

Characteristics of the internship contract

This type of contract is always made in writing., where in addition to putting what degree you have, you put the duration of the contract, the type of job, working hours and what the working day will be like.

Another very important point for those who sign an internship contract is the remuneration that will be received. Although it will be based on the level of studies and the collective agreement, the truth is that the labor reform of 2022 changed this a bit.

Now the salary must be determined in the collective agreement or in that of the professional group. In case you don't know, before, 60% of the fixed salary was offered to a worker in the same job but without an internship contract (75% in the case of the second year). However, at present this is already fixed.

How long does an internship last?

The internship contract has a minimum duration of 6 months and a maximum of 12 months, and during this time, as we have explained to you before, a remuneration is received. Before, this could be less than the interprofessional minimum wage (because there was talk of 60 or 75%). But today it does ensure that a trainee has at least that minimum interprofessional salary.

However, during this period you have the same benefits and rights as the rest of the company's employees.

Requirements to sign an internship contract

After learning a little more about the internship contract, would you like to know if you are qualified to be offered one? Keep in mind that the labor reform that took place in 2022 has changed some conditions, but most of them are the following:

  • Have a university degree or intermediate or higher vocational training, a professional certificate or equivalent in the last three years (five if they are disabled).
  • Not having had a training contract in the company for more than three months (this invalidates you from signing an internship, unless you were an intern).
  • Not having had a previous one-year internship contract. Before, the internship contract could be held for a maximum of two years, but with the new reform this was shortened and if you already have one year of this type of contract, you cannot celebrate another. Even having it less, they could only make you one with the maximum total duration of one year.

When does the internship contract expire?

Termination of the internship contract can occur due to two situations:

  • The trial period is not exceeded, that is, one month from the signing of the contract (unless otherwise stated by collective agreement).
  • There is a disciplinary dismissal.
  • There is a dismissal for objective reasons.
  • The maximum period of an internship contract is fulfilled, which right now is one year.

It must be taken into account that, except in dismissal for objective reasons, You are not entitled to compensation for losing your job. Only in that case would 20 days of salary be paid per year worked.

Once Once the contract has ended, the company must give the worker a certificate of internships stating the duration of the internships, the job position and the tasks that have been carried out and, sometimes, a comment about the skills that the worker has acquired (a kind of recommendation).

Benefits of the internship contract

Person hired to start a job

Now that it is a little clearer to you what the internship contract is likeDo you want to know what advantages it has? The truth is that there is both for the employer and for the worker.

Roughly speaking, the main ones that it has are the following:

  • The company can benefit from a 50% reduction in Social Security contributions (for common contingencies) in the case of hiring people with disabilities equal to or greater than 30%. In the event that they are unemployed hired in CEE then they will have 100% of the subsidized business contribution.
  • There may be bonuses when converting an internship contract to an indeterminate one. This will only be available to companies with fewer than 50 workers. If so, by transforming the internship contract into an indefinite one, if it is a man you get a bonus of 500 euros a year, and 700 in the case of women.
  • Obtain a connection from the worker of the training he has received and the practice in the labor market to apply it. Although at first he has the necessary knowledge to adapt to the job, it must not be forgotten that he is an "apprentice" and that, as such, he must have someone to explain and help him know how to do the job.

As you can see, the internship contract can be a first approach to the labor market that occurs when a career is ending or has recently ended. In this way, it is an intermediate step to be able to apply the knowledge that is acquired in training to practice, knowing that there is someone who will help you to know what you have to do. Have you ever had an internship contract?
